Terms and Condition

By Using AllureKiss Web Hosting services, you signify your agreement to these terms of service. If you do not agree to these terms of service, please do not use AllureKiss Web Hosting services. AllureKiss reserves the right, at its discretion, to add, change, modify, or remove portions of these terms at any time. Please check these terms regularly for changes.

Services

Subject to the terms of this Agreement, and contingent on clients satisfaction of AllureKiss credit approval requirements, AllureKiss agrees to provide the web hosting services described in the Order for the fees stated in the Order.

AllureKiss can not give any guarantee on a setup time of which clients order(s) will be activated. While most orders will be activated within 1-12 hours, AllureKiss can not guarantee setup within this time as all orders are processed and activated manually.

Client will be held responsible for all actions performed by their account whether it be done by them or by others. If server security is compromised, the account holder is responsible for all violations of the terms of service. Client is also responsible for disconnect and reconnect fees associated with violations.

Payment

We are accepting payments via Paypal.

Refunds
Under no circumstance will AllureKiss Web Host issue a refund unless necessary. As soon as you send your payment, it becomes 100% non-refundable under any circumstances.

Domain Names

Any domain name registered through AllureKiss remains sole possession of AllureKiss.

Domain transfers, name-server changes and hand-overs will only be fulfilled if you pay an upfront fee of $10.00. If, under any circumstance, a clients account is suspended, terminated or blocked, the domain will become unaccessible unless you pay the upfront unlocking fee of $15.00.

Audio or video streaming
Phishing Sites
Fraud sites
Spam websites
Spamming Email / Mass Email
Gambling Websites
Arcade Gaming Websites
Pirated Scripts
File Hosting Sites
File Hosting / Backup hosting
Proxy Sites / IRC
Any form of warez hosting or linking
Adult Sites
Illegal / Child Pornography
Torrentflux or similar
Rapidleech or similar
Outdated scripts or software
PHPizabi and YaBB Forums or any forums using flat file as database
Any script that has an adverse effect on the server
Scripts using more than 5% of server resources

If restricted content as mentioned above is found on your account, AllureKiss reserves the right to remove it and terminate or suspend your account with or without prior notice, depending on the severity and nature of the offense.

Restricted Use of Mail

* Sending unsolicited mail messages, including the sending of ‘junk mail’.
* Harassment, whether through language, frequency or size of messages.
* Unauthorized use, or forging, of mail header information.
* Creating or forwarding of ‘chain mail’.

Scripts

All Scripts, must be updated to the latest released versions as soon as possible. Any insecure and/or bugged scripts will be removed from the servers without notice.

File Usage and Storage

Hosting accounts are not to be used for the purposes of distributing and/or storing an unusual amount of files. We are a web hosting service not a remote file storage service. Any web site whose disk space usage for storing the files exceed 50% of its total usage, either in terms of total size or number of files, will be deemed to be using unusual amount of files. At that point, if we find that those files are illegal or harmful in any way, you will be suspended or terminated with or without prior notice depending on the severity of the harm.

Server Abuse

Any attempt to undermine or cause harm to ours or others’ servers is strictly prohibited. As our client, you are responsible for all your accounts. Should you violate all the terms listed in this page, your account will be terminated immediately without a refund.

Downtime

Although our priority is uptime, server errors, power failures and other technical problems will, inevitably, leave us with server downtime. To reiterate, we cannot guarantee your website, account, webmail and more will be accessible 24/7.

Data Loss

In rare cases, some clients may experience data loss (where some of their files — or all of their files — may have disappeared). We cannot be held responsible for data loss under any circumstances. It is strongly recommended to keep your own backups incase a rare event such as this does happen.

Active Accounts

Your website should be active – that is, it is either receiving ‘hits’ or is being updated/posted to. Sites that either receive no hits or are not updated over a period of 60 days will be considered ‘inactive’ and may be removed by AllureKiss Web Host to make room for other users.

Accounts on the server that use zero (0) megabytes of bandwidth for 90 days will be terminated.No back-up will be made for the accounts terminated.

Account Termination and Suspension

We have the right to terminate and/or suspend your account with or without notice, based on your violation of our policy. By ordering hosting from us, you accept this agreement. All termination and suspension are based on our judgment and discretion. No refund or monetary compensation will be given to your account is suspended or terminated.

Backups

You are responsible for backing up your and your clients’ sites and keeping your backup copy up to date.

Privacy

We will never give out, trade, distribute, or sell your information to parties outside of AllureKiss. Our employees have access to your account and information such as name and email are used for support purposes only. We promise to keep your information safe and secure.

Failure to fully comply with these terms is grounds for account suspension or termination (with or without refund, subject to management’s discretion). Any accounts contained within AllureKiss network must adhere to the above policies.

No backups or refunds will be given. Domains will stay in our possession.
